A conservative fifth circuit court of appeals overturned a ban on plastic containers made by a company called Inhance. Those container leech PFAS “forever chemicals” at “alarming levels” into anything put into the containers. "The fifth circuit judges wrote that the EPA would have to regulate the containers under section 6 of the Toxic Substances Control Act (TSCA), which the judges and Inhance claim would require the EPA to take into account the economic impact on Inhance. The company has said a ban on its fluorination process would put it out of business." Seems like they should be put out of bus... micro.bradbarrish.com

@bradbarrish Very interesting issue. I’m a Public Law attorney (in Spain, I know very little about US law) so I can imagine the technical complexities of these kinds of proceedings. It does look like a serious environmental and health risk. Let’s hope that “this case isn’t over by any stretch,” like Kyla Bennett said.

@eumrz I am not an attorney, but it seems to me poisoning people is bad and any company knowingly doing so should be held accountable and/or put out of business.

@bradbarrish I agree, but there’s procedures for that that need to be followed all the way through.
